Patent Cooperation Treaty (PCT): National Phase

The National Phase is when an international patent application enters the respective foreign patent offices.  The foreign patent offices review the respective applications for patentability.  When approved, the foreign patent office issues the foreign patent.

The national phase involves hiring a foreign associate (i.e. a local patent attorney), translating the application and related documents to the required language, complying the international application to local regulations, and then prosecuting the application.

Hiring a foreign associate can be a dangerous proposition.  The attorneys must be qualified to do the work and to appreciate the technical subject matter.  Bad associates can miss deadlines, communicate poorly, and exceed budgets.

We act as our clients outside patent counsel to engage with only the best foreign associates.  We use strict procedures to communicate with the foreign associates and we only work with foreign attorneys who comply with our budgeting and billing requirements.
